This agreement outlines the terms between Find An Entertainer (“the Agent”) and any third party (“the Client”) who books entertainment services via the Agent.
1.1 Agent refers to Find An Entertainer or any of its appointed representatives. 1.2 Client means any individual, company, or organisation booking an act, performer, or entertainment service via the Agent. 1.3 Performer refers to any entertainer, act, or supplier engaged through the Agent. 1.4 Engagement refers to the booking, service, or performance requested by the Client. 1.5 Booking Confirmation is the written agreement issued by the Agent confirming the details of the Engagement. 1.6 Performance Fee is the total cost of the Engagement, payable by the Client. 1.7 Deposit is the initial payment required to secure the booking. 1.8 Force Majeure refers to events beyond reasonable control (e.g. serious illness, accidents, extreme weather) that prevent fulfilment of the contract. 1.9 Working Day means Monday to Friday, excluding public holidays in England and Wales.
2. General Terms
2.1 These terms apply to all bookings made through Find An Entertainer and override any prior agreements unless confirmed in writing by the Agent. 2.2 By confirming a booking via the Agent (whether by email, message, signature, or online acceptance), the Client agrees to these terms. 2.3 The Agent acts as an intermediary between the Client and the Performer. The contract for services is between the Client and the Performer, facilitated by the Agent. 2.4 Any changes to the booking must be agreed upon in writing with the Agent.
3. Booking Process
3.1 A Booking Confirmation will be issued outlining all agreed details (e.g. date, time, location, performer name, fee). 3.2 Bookings are not final until the deposit is paid and the Client has agreed to the terms. 3.3 The Agent reserves the right to decline or cancel a booking if payment is not made in a timely manner or if key details are missing.
4. Payments
4.1 A non-refundable deposit is required to secure the booking. 4.2 The balance of the Performance Fee must be paid by the due date stated on the Booking Confirmation (typically no later than 7 days before the event, unless otherwise agreed). 4.3 Late payment may result in cancellation of the Engagement and loss of deposit. 4.4 All payments must be made via BACS unless another method is agreed. 4.5 The Client is responsible for any bank charges incurred during the payment process.
5. Client Responsibilities
5.1 Ensure the venue is safe, accessible, and suitable for the Performer. 5.2 Provide any key logistical details in advance (e.g. parking arrangements, set-up times, performance area). 5.3 Treat Performers and agency staff with respect and professionalism. 5.4 Ensure that all necessary permissions or licenses (e.g. music licenses, event insurance) are in place, where applicable. 5.5 Allow the Performer to work without unreasonable disruption or interference. 5.6 Do not request the Performer remain on site longer than agreed unless an extension is arranged via the Agent. 5.7 Do not attempt to book the Performer directly for future events without going through Find An Entertainer.
6. Cancellations & Changes
6.1 Cancellations by the Client must be made in writing. 6.2 In the event of cancellation: - More than 60 days before the event: deposit is retained. - 30–60 days: 50% of the remaining balance is due. - Less than 30 days: 100% of the total fee is payable. 6.3 Date changes are subject to availability and may incur additional charges. 6.4 If a Performer becomes unavailable due to illness or Force Majeure, the Agent will make every reasonable effort to provide a suitable replacement. 6.5 If no suitable replacement can be found, a full refund will be issued.
7. Conduct and Behaviour
7.1 The Client must not pressure Performers to do anything outside of what was agreed in the Booking Confirmation. 7.2 The Agent will not tolerate abusive, discriminatory, or inappropriate behaviour towards any Performer or team member. 7.3 In the case of unacceptable behaviour, the Performer reserves the right to end the performance early. No refunds will be issued in such circumstances.
8. Use of Media
8.1 The Client agrees that Find An Entertainer may use images or video taken at the event (where appropriate and respectful) for promotional purposes unless otherwise requested in writing. 8.2 Any recordings of Performers must be for personal use only and not distributed commercially without written consent.
9. Liability and Insurance
9.1 The Agent accepts no liability for damage, loss, or injury resulting from the actions of the Performer or third parties. 9.2 Performers are required to have valid public liability insurance and ensure their equipment is safe and PAT-tested. 9.3 The Client is advised to have their own event insurance in place.
10. Data Protection
10.1 The Agent will store and process Client data in accordance with UK GDPR regulations. 10.2 Personal information will not be shared with third parties outside the scope of the booking without consent.
11. Entire Agreement
This agreement represents the full understanding between the Agent and the Client regarding the booking of entertainment services. It is governed by the laws of England and Wales. Any disputes will be subject to the jurisdiction of the English courts.
Effective Date
This policy is effective as of the 1st April 2025.
